1. General

International (Hong Kong), Limited trading as Lock Health (“L&H “, “we”, “us”, “our”) owns and operates all the retail shops and promotion activities of Lock Health in Hong Kong.
1.2 We recognise the importance of your privacy and maintaining the confidentiality of your personal information. This Privacy Policy applies to all products and services provided by us and sets out how we may collect, use and disclose your personal information.
1.3 We pledge to comply with the requirements of the Personal Data (Privacy) Ordinance (Cap. 486) ( “HK Privacy Ordinance”) in Hong Kong. In doing so, we will ensure compliance by our staff with the strictest standards of security and confidentiality.
2. Collection of Customer’s Personal Data
2.1 Your privacy is important to us and we have taken steps to ensure that we do not collect more information from you than is necessary for us to provide you with our products and/or services.
2.2 We may ask you to provide personal information when you use our website and services, including when you apply for membership. The personal data that we may ask you to supply include without limitation to salutation, name, month of birth, telephone number and email address.
2.3 Please note that it is mandatory for you to provide certain categories of Personal Data. In the event that you do not provide any Personal Data marked as mandatory, we may not be able to provide you with our products or services.
3. Use of Personal Data
3.1 If you provide any Personal Data to us, you authorise us to collect, retain and use Personal Data about you for the following purposes:
3.1.1 verifying your identity;
3.1.2 verifying your eligibility to participate in our promotion activities;
3.1.3 processing your application for membership under any of our promotion and maintaining and managing your membership under any of our promotion;
3.1.4 providing you with a log-in ID for our website;
3.1.5 providing you with rewards, vouchers or services under any of our promotion;
3.1.6 providing you with customer service and responding to your queries, feedback or claims;
3.1.7 performing research or statistical analysis in order to improve our products and services and for marketing and promotional purposes; and
3.1.8 making such disclosures as may be required for any of the above purposes or as required by law or in respect of any feedback or claims made by you.
3.2 You further agree that we may disclose and transfer your Personal Data to third party services providers engaged by us to provide
3.2.1 data entry services
3.2.2 customer database management services
3.2.3 customer contact services (and service providers may contact you regarding promotions, products rewards, vouchers and redemption letters and customer service), and
3.2.4 secure data disposal services (“Third Party Service Providers”).
These Third Party Service Providers are under a duty of confidentiality to us and are only permitted to use your Personal Data in connection with the purposes specified at Article 3.1 above, and not for their own purposes (including direct marketing).
3.3 When necessary we may also disclose and transfer your Personal Data to our professional advisers, law enforcement agencies, insurers, government and regulatory and other organisations for purposes specified at Article 3.1.8 above.
3.4 Only with your consent or with your indication of no objection, we may use your name, phone number and email address (“Marketing Data”) to provide marketing materials to you relating to the promotion and goods/services. If you wish to opt out from receiving any Marketing Materials, you may send your request in writing to the address advised in Article 8.2 below.
3.5 We may share aggregate data that does not allow you to be identified with third parties for various purposes (including marketing and advertising), and may use this data in order to better understand your needs and to improve and adapt our products and services.
3.6 Any Personal Data supplied by you will be retained by us and will be accessible by our authorised employees, any Third Party Service Providers engaged by us and third parties referred to Article 3.1 above, for or in relation to any of the purposes stated in Article 3.3 herein.
4. Confidentiality
4.1 Personal Data held by us relating to our promotion plan members, customers, or visitors to our websites will be kept confidential in accordance with this Privacy Policy.
4.2 Any questions, comments, suggestions or information other than Personal Data sent or posted to the site, or any part of the site, by visitors will be deemed voluntarily provided to us on a non-confidential and non-proprietary basis. We reserve the right to use, reproduce, disclose, transmit, publish, broadcast and/or post elsewhere such information freely, including passing it to any associated company for example, in connection with the development, manufacture and marketing of products and services and to meet customer needs.

7. Information Collected When Customers Use Our Website

9.1 Notwithstanding the Contracts (Rights of Third Parties) Ordinance and/or any comparable law in any jurisdiction, this Privacy Policy is personal to and is made solely for the benefit of you and USA L&H Health International (Hong Kong) Limited, and shall not create or give any rights to or purport to confer any benefits on any third parties whatsoever. The application of the Contracts (Rights of Third Parties) Ordinance and/or any comparable law in any jurisdiction giving to or conferring on third parties the right to enforce any term of this Privacy Policy is expressly excluded and no term of this Privacy Policy is, or is intended to be, enforceable by any person not being a party to it. Notwithstanding the foregoing in this paragraph, third party rights under this Privacy Policy shall be enforceable by USA L&H Health International (Hong Kong) Limited and/or an entity which, as at the time of enforcement, is a direct or indirect wholly-owned subsidiary of USA L&H Health International (Hong Kong) Limited Company in accordance with the Contracts (Rights of Third Parties) Ordinance and/or any comparable law in any jurisdiction. The rights of the parties to terminate, rescind, or agree any amendment, waiver, variation or settlement under or relating to this Privacy Policy, is not subject to the consent of any third party.

1.1 These terms, conditions and disclaimer apply to users of the Lock Health website at www.usalh.com (the “Website”). Lock Health and the Website are owned by USA L&H Health International (Hong Kong) Limited (“Lock Health”, “we”, “us”, “our”). Your use of the Website is governed by these terms, conditions and disclaimer of use .
1.2 Please read these Terms of Use carefully before using the Website. By using the Website or any part of it, you agree that you have read these Terms of Use and that you accept and agree to be bound by them.

7.1 Lock Health shall not be liable to the User or any other person whether in tort, contract, statute or otherwise (including without limitation for negligence, breach of contract, defamation, or intellectual property right infringement) for:
7.1.1. any direct loss;
7.1.2. any consequential or indirect loss (including without limitation loss of revenue or profits); or
7.1.3. the User’s liability to any other person, which is suffered or incurred by the User or any other person arising under or in any way out of the Information or www.usalh.com’s use.

8.1 We does not warrant (and accepts no responsibility for) confidentiality of any information or data whether personal or otherwise transmitted through www.usalh.com. Lock Health’s current practice is to take reasonable steps to maintain confidentiality.
9. Availability and Suitability of Services
9.1 We does not warrant that the information or materials contained in www.usalh.com are current or accurate or that any of the products or services featured on www.usalh.com are available. we may change the materials appearing on www.usalh.com at any time without notice.

11.1 User agrees to hold Lock Health harmless and indemnify Lock Health against all losses, damages, claim, demands, liabilities, costs (including legal costs), and expenses in connection with your use of www.usalh.com in breach of the terms and conditions herein or negligence.
12. Law Applicable
12.1 Hong Kong law governs this notice, and each part of this notice shall apply to the extent permitted thereby. Any part of this notice which is prohibited or unenforceable in any jurisdiction is ineffective as to that jurisdiction only to the extent of the prohibition or unenforceability. That does not invalidate the remaining parts of this notice nor affect the validity or enforceability of that part in any other jurisdiction.
